Now at this day comes the Plaintiff by Attorney D.L. Fulbright and dismisses this Suit in Vacation. It is therefore considered by the Clerk in Vacation that said suit be dismissed and that the Plaintiff be permitted to withdraw the instrument sued on.

Delinda Craig et al Defendants
Now at this day comes the said Plaintiff and files their petition verified by affidavit and stating that said Defendant Delinda Craig is a non-resident of this State of Missouri, wherefore it is ordered by the undersigned Clerk that she be notified by publication of the commencement of this action the object of which is to obtain a -Judgment of partition and division of the following described real estate situate in the County of Greene in said State, to wit: the SW 1/4 of SE 1/4 of Sect 16 TWP 27 Range 24, the S 1/2 of SE 1/4 of Sec 9 TWP 30 Range 24, the SE 1/4 of SW 1/4 of Sec 9 TWP 30 Range 24, the E 1/2 of NW 1/4 of Sec 16 TWP 30 Range 24, the W 1/2 of NW 1/4 of -Sect 16 TWP 30 Range 24, the E 1/2 of NW 1/4 and W 1/2 of NE 1/4 of Sect 21 TWP 30 Range 24 also Military Land Warrant No 16217 of which Nathan Boone late of said County, deceased, seized and that unless she be and appear before said Court at the next term thereof to be begun and held at the City of Springfield on the first Monday of September, next, and on or before the third day thereof answer said petition the same will be taken as confessed, and it is further ordered that this order be published in the weekly SPRINGFIELD ADVERTISER for four weeks successively the last insertion to be at least four weeks before the said next term of this Court.

It is therefore considered by the undersigned Clerk in Vacation that the said suit be dismissed and that the said Appeallee take nothing by his suit and that the Appellant have and recover of and from the said Applee his costs in this behalf laid out and expended and have execution therefor.

Whereas an order was made by the Judge of the Greene Circuit Court at the September Term 1856 ordering the Sheriff of Greene County to sell the real estate of James C. Turner, deceased, for the purpose of Partition at the March Term 1857 of said Court and whereas there was a failure to hold said March Term of said Court it is therefore ordered by the undersigned Clerk of said Court that the Sheriff of Greene County sell said real estate mentioned in said order that he advertise and sell the same as the Law requires.

EXPARTEE Petition for Partition
Whereas an order was made by the Judge of Greene Circuit Court at the September Term thereof 1856 ordering the Sheriff of Greene County to sell the real estate belonging to the minor heirs of Lewis D. Barham, deceased, and William L. Thompson as tenants in coparcenary for the purpose of partition at the March Term 1857 of said Court and whereas there was a failure to hold said March Term of said Court, it is ordered by the undersigned Clerk of said Court in Vacation that the Sheriff of Greene County sell said real estate mentioned in said order after advertising the same as the Law directs.

IN VACATION SEPTEMBER 22, 1857.

A. Fine Defendant
Now at this day comes the said Plaintiff and files his petition with the undersigned Clerk in Vacation verified by affidavit setting forth that the said Defendant is indebted to him on several demands amounting to the sum of $123.85 and it also appearing to the satisfaction of the undersigned Clerk of the Greene Circuit Court that the said A. Fine is a non-resident of the State of Missouri and that ordinary process of Law cannot be served upon him. It is therefore ordered by said Clerk in Vacation that publication be made in the weekly SPRINGPIELD ADVERTISER a newspaper printed in the State for four weeks successively the last insertion to be at least four weeks before the next term of this Court which commences on the first Monday in March 1858 and plead answer or demurr to Plaintiff petition or the same will be taken as confessed and a

The Sheriff received the following order from the Judge of the 13th Circuit Viz
To The Sheriff of Greene County
In the State of Missouri

Sir: You are hereby notified that I cannot attend to the next Regular Term of the Greene County Circuit Court which is to commence on the first Monday in September, next, you therefore are required to adjourn said Circuit Court by proclamation at the Court House Door in said County of Greene until the fourt Monday in November 1857.
