IN THE CIRCUIT COURT OF TANEY COUNTY, MO. — —David J. Snapp, administrator de bonis non, of the estate of H. G. Snapp, deceased, plaintiff, against William C. Berry, defendant. Now at this day comes the plaintiff in the above entitled cause, by his attorney, before the undersigned, Clerk of the Circuit Court, of Taney county, Missouri, in vacation, and files his petition and affidavit, stating amongst other things that the above named defendant, Wm. C. Berry, in the above entitled cause, is a non-resident of the State of Missouri, so that the ordinary process of law cannot be served upon him; It is therefore ordered by the clerk aforesaid, in vacaion, that publication be made notifying said defendant, William C. Berry, that an action has been commenced against him, by petition and attachment, in the circuit court of Taney county, in the State of Missouri, founded on two notes; one for two hundred and ninety dollars, payable twelve months after date; one payable to Delilah Clapp, for six hundred dollars on the said H. G. Snapp and William C. Berry; and that his property has been attached, to-wit: The s e qr. of the n e qr. sec. 34, and s w qr. and n w qr. of sec. 33, town. 24, rage 20; also town lots number 73, 78, 74, 77, 75, 58, 59, 56, 28, 82, 83, 84, 85, 86, 87, 88, 91, 92, 93, 100, 101, 102, 105, 106, 107, 108; and that unless the said William C. Berry, the defendant, be and appear at the next term of said court, to be holden at the court house in the town in Forsyth, in the county and State aforesaid, on the SECOND MONDAY IN OCTOBER, A.D. 1869, and on or before the third day thereof, (if the term shall so long continue, and if not, then before the end of the term,) and plead, answer, or demur to plaintiff’s petition, the same will be taken as confessed and judgment rendered and his property sold to satisfy the same.

It is further ordered that a copy hereof be pubished in the Springfield PATRIOT, a newspaper published in Greene county, Missouri, for four weeks successively, the last insertion to be at least four weeks before the commencement of the next term of this court.
