KNOW ALL MEN BY THESE PRESENTS, that WILLIAM P. BURCHFIELD of the County of Stone and State of Missouri for and in consideration of the sum of three hundred and fifty dollars, to me in hand paid, the receipt of which is hereby acknowledged, have this day bargained, granted, sold, and conveyed and do by these presents bargain, grant, sell and convey unto James Mitchell of the County and State aforesaid, all my right, title and interest, and claim as heir and distributor of the real estate of my deceased father, John Burchfield estate consisting as follows -first, my individual interest in said real estate of my deceased father, John Burchfield, according to the last will of said deceased; secondly, the respective interests of Nathaniel Kimberling and Nancy, formerly Nancy Kimberling, his wife; F. W. Enloe and Jane Enlow, formerly Jane Burchfield his wife; John Cox and Frances, formerly Frances Burchfield, his wife; Johnathan Raley and Rachel, formerly Rachel Burchfield, his wife; Samuel Shumate and Mary E., formerly Mary E. Burchfield, his wife; and Pleasant Byrd, in right of his deceased wife, Malinda, formerly Burchfield; and Alexander Berry and Phoebe, formerly Phoebe Burchfield, his wife; all of whom several and respective into rests having been heretofore purchased of the said Nathaniel Kimberling and others named in the second division of right by me hereby conveyed of the said several heirs, distributors therein mentioned and by the said several heirs therein named heretofore conveyed to the said W. P. Burchfield, to have and to hold to the said James Mitchell, his heirs and assigns, and I do hereby authorize and enpower the said James Mitchell to apply for and receive in his own name and rights all the distributive interests and shares aforesaid whenever the same shall be due and payable according to the terms and conditions of the last will aforesaid and I do hereby guarantee all and several the interests aforesaid to him the said James Mitchell, his heirs and assigns. A noncupative will of JOHN BURCHFIELD, DECEASED, IN THE PRESENCE of Issac Bledsoe and William P. Burchfield; I wish my wife, Nancy B. to have my upper place containing 40 acres of land during her natural life; also snip mare and colts, two cows and calves, all my household furniture and after the death of my wife, Nancy Burchfield, I will all the above-named property to Thomas Ben-ton Burchfield, in case of the death of said Thomas B. Burchfield, I wish said property sold and equally divided among my lawful heirs. I wish my two lower places rented out and the proceeds applied to the support of my small children. When my heirs all become of age I wish the two lower places sold and equally divided between my heirs. I also wish my son James Burchfield in case he should be able to administer my estate to do so: in case of his inability to attend, then any other good men or man.
