At a special term of the Greene Circuit Court begun and held at the Court House in the city of Springfield in the county of Greene on Tuesday the 26th day of September A.D. 1848 for the trial of Ezekiel Merriman who is confined in the Jail of said County under a commitment of manslaughter in a charge of murder at which Court are present The Honorable Charles S. Yancey Judge of said Court, George W. Kelly esq, Sheriff, John T. Coffee esq, Circuit Attorney and Joshua Davis Clerk.

Now at this day the Sheriff aforesaid returns here into Court upon the veniri facias to him for that purpose directed the following Panel of Grand Jurors, to wit: Higdon R. Jarratt foreman 1. Edward Moore 2. Daniel Chandler 3. Wyatt Sandford 4. Samuel Lee 5. Theophilus Leathers 6. Jesse Birton 7. Jeptha Wallis 8. John Delaney 9. Stephen H. Julian 10. Allen Robberson 11. Charles B. Ellis 12. George F. Howard 13. James M. Russell 14. Joseph H. Miller 15. Ralph Lotspeech 16, sixteen good and lawful men who being empanelled sworn and charged as Grand Jurors for the Court aforesaid retired to consider of their duties.

p 268. Wednesday morning Septemper 27th.
Now at this day came the Grand Jury empanelled at this special term of this Court and return here into court the following indictment as a true bill.

Ezekiel Merriman Defendant
Now at this day comes as well the Circuit Attorney who prosecutes for the said State in this behalf as the said Defendant in his own proper person and on motion of said Circuit Attorney and for good cause shown to the Court it is ordered by the Court that this cause be continued until the next term of this Court. Now at this day come Sarah Phillips, Thomas Lemonds, David Ross, James Johnson, Franklin Strong, David L. Mallicoat, George Matthews, Barrett Lemonds, George Phillips, Elbert 5. Barrett, Thomas Perryman, Martha Looney, John Cook, Christian Matthews, Clinton Barrett, William E. Williams, Green B. Adams, Wilson Edwards and Isaac Julian who acknowledge themselves to owe and stand justly indebted to the State of Missouri in the sum of $50 each to be levied of their respective goods and chattles lands and tenements to be void upon condition that the above cognizers be and appear before said Circuit Court House in the city of Springfield in said County on the third Monday after the fourth Monday of October next then and there to testify on the part of said State in a cause in said Court pending betwee n said State and Ezekiel Merriman and not depart said Court without leave then this recognizance on the part of such of said cognizors as shall comply with the above condition shall be void otherwise to remain in full force and virtue.
