"On 7 April 1921, the Defendant requested Plaintiff to go with him in his automobile to a small town in Polk County, Mo., and after they had started, told her that he had obtained a license, and that Plaintiff and Defendant would be married that evening; that there had never been a courtship by Defendant of Plaintiff; their acquaintance was only a casual one, and the only suggestion of marriage prior to that occasion was a jesting one at a school gathering, when several young men, including Defendant, proposed to the young ladies they happened to be talking to at the time, which proposals were all accepted in the same spirit, and the Defendant at that time, as a joke proposed to Plaintiff, who, as did the other young ladies, accepted, and gave the matter no thought further. The Plaintiff had never been spoken to relative to the marriage, except in jest and told Defendant she could not marry him. That Defendant by threatening to kill himself and by flourishing a revolver and by driving the car at a rapid rate and threatening to wreck the car with Plaintiff and Defendant in it, so menaced and frightened Plaintiff that she consented to the marriage and while her will was so overcome and paralyzed by fear she was driven to the house of a minister and the marriage ceremony said. That the marriage was never consummated, that Plaintiff never lived with Defendant and the only tie binding them is the said ceremony solemnized under duress and fear." The marriage was set aside, annulled and voided and for naught held or esteemed. Maiden name, Dollie E. Vaught, restored.
